GDPR: Rights and Obligations for Associations

What does data protection mean according to the GDPR?

Data protection refers to the protection of people whose personal data is collected and used. Moreover, this is based on the principle that each person should decide to whom to disclose which kind of data. This is also an obligation for clubs and associations.

What is personal data for Association?

This refers to all data that can be associated in any way with a single natural person. For example, referring to a list of members, seen as this already contains personal data. Furthermore, this includes name, age, marital status, postal address, e-mail address, account and credit card number, player and health data, certificates, pictures, etc. In the end, almost any type of storage is personal data.

What rights do the persons whose data are processed have?

According to the GDPR, technical and organisational measures must enable the following for the group of people whose data are processed. These people must:

  • Be able to give their consent
  •  Be able to enter an objection
  •  Have the guarantee of being able to request access to the data 
  •  Be able to inquire about the intended use 
  •  Be allowed to correct or delete the data

Members and website visitors are allowed to deactivate any kind of email from the association, for example, the association’s newsletter, at any time.

By deactivating these emails/newsletters as an association member, this member is still in the database, allowing this person to continue receiving invoices and other important information from the association.
